A Crossroads for Vaping
The vaping industry in the United States is at a critical turning point. Once seen as a groundbreaking tool for harm reduction, especially for adult smokers looking to quit, vaping now faces growing public health concerns, strict regulation, and political pushback.
At the center of the debate is a key question: Should vaping be banned because of potential risks, or should it be recognized and responsibly regulated as a public health solution? The answer matters, not just for the industry, but for public health, small business owners, and millions of adults trying to leave cigarettes behind.
Federal Overreach and Regulatory Pressure
The Food and Drug Administration (FDA) has significantly ramped up enforcement against vape manufacturers. Since gaining authority over vaping products in 2016, the FDA has rejected millions of applications for premarket tobacco product authorization (PMTA), effectively banning a wide range of e-cigarettes from legal sale.
In addition, President Biden’s 2023 omnibus bill closed a loophole around synthetic nicotine, granting the FDA broader power to regulate products that previously existed in a legal gray area. While these moves are framed as measures to protect youth and public health, they have disproportionately harmed small businesses and adult consumers who rely on vaping as a smoking cessation method.
Mixed Messages and Misunderstood Data
The inconsistent patchwork of rules and changing guidelines creates confusion for consumers, businesses, and even health officials. While youth vaping is frequently cited as the main concern, the latest data tells a different story.
According to the CDC’s 2024 National Youth Tobacco Survey, only 7.8% of high school students and 3.5% of middle school students reported using e-cigarettes in the past 30 days. That means more than 92% of high schoolers and 96% of middle schoolers do not vape. These numbers show a major decline from earlier years. In fact, high school vaping rates dropped from 14.1% in 2022 to 7.8% in 2024.
At the same time, millions of adults credit vaping, especially flavored options, as the only method that helped them quit smoking for good. Protecting youth is vital, but we should not create policies that punish adults working toward healthier lives.
Flavors Help Adults Quit
Flavors are often blamed for attracting teens, but for many adult smokers, flavored vaping products are essential to quitting. Menthol, fruit, dessert, and drink-inspired flavors help people move away from the taste of cigarettes and reduce the chances of relapse.
Eliminating these choices doesn’t help public health, it harms it. When adults cannot find satisfying alternatives, they may return to smoking or turn to unsafe, unregulated markets. Flavored vapes are not just preferences. For many, they are the key to staying smoke-free.
States Leading the Way
Some states are pushing back against overreaching federal policies. In 2024, Iowa and Tennessee passed laws protecting access to flavored vaping products. Iowa affirmed the legal sale of flavors, while Tennessee confirmed the state’s right to regulate vapor products independently.
These laws are not about ignoring youth risks. They aim to protect both youth and adults and show that there are better alternatives than blanket bans.
The Economic Impact
The effects of federal overreach are not only felt in health. They also hit local economies. Vape shops, independent manufacturers, and small distributors are being crushed by unclear and constantly shifting regulations.
Unlike big corporations, many of these businesses are owned by former smokers who are passionate about helping others quit. When the rules become impossible to follow, these shops close, jobs are lost, and adult consumers lose trusted support systems.
Global Lessons in Success
There is a better path forward. Countries like the United Kingdom and New Zealand use vaping as a public health tool. In the UK, smokers are encouraged to switch to vaping. The government even gives out vape kits to help people quit. As a result, smoking rates continue to fall.
Meanwhile, in the United States, fear-based messaging and inconsistent policies leave adult smokers without clear options or support. If we do not shift our focus, we risk falling behind—and leaving millions of smokers without a way out.
Harm Reduction Should Be the Goal
Smoking still kills nearly 500,000 Americans each year. While vaping is not completely without risk, leading health experts agree that it is significantly less harmful than smoking. Groups like Public Health England and the Royal College of Physicians support vaping as a safer alternative.
In the U.S., vaping is too often treated as a threat instead of a solution. This attitude ignores the science and the personal success stories of adults who have quit smoking through vaping.
What’s at Stake
This fight is bigger than the vaping industry. It is about health, freedom of choice, and access to tools that help people quit smoking. It is about giving adults the chance to change their lives, not by force, but by offering real, effective alternatives.
Flavored products are not just nice to have. They are critical to the process of quitting for millions. Regulations must reflect this truth—not erase it.
